No.of days allowed to stay in US with H1 without payroll

Hi,

My wife's H1 got approved this year and activated from Oct 1st 2014 and her H4 expired exactly on Sep 30th. She is yet to get a job and the employer who filed H1 is yet to run the payroll as she didn't get a project yet. How long is she allowed to stay in this status ? What are possible risks in this status ?

If she is on H1B, she needs to be having a job and having her payroll run. By not doing so, not only she is now out of status in the US, continued status quo is sure to deeply complicate matters for your wife and you.

You might need to speak to some Immigration Attorney to understand your options.
