Apply for H1 after I-140 petition ?

Hi,

Can anyone tell me if it is possible to get a H1 visa at a Consular Office after I have filed an I-140 petition? Would I be rejected due to immigration intention? Someone told me H and O visa are dual-purpose, ie, immiggration intention is allowed.

H1 is dual intent. Filing I-140 is no problem.
