    Hi,

    I have 4+ years experience and working in a top MNC company in India. I'd like to work in USA. My current employer said, they will process H1 visa for 2017 [they will file on April 1 2016]

    I found a US consultancy who can file a H1 for 2016 [they will file on April 2015], one of my friend is also works in the same consultancy.

    I am confused now, Do I wait till my current employer to process the visa or Can I file H1 through US consultancy ??

    Please advise me, I would like to hear from you guys. Thanks in advance.

    Hi,

    If you are already in USA and would like to move to local Employer, then that should be fine. After you work for minimum 3-4 months under local employer if you go for stamping then there wont be any issues as you already would have enough pay checks and other docs to prove that your job and employer.

    But if you are in India, then it is better to come to USA through MNCs.

    The advantages are when you go for stamping the officer wont ask too many things (in most cases) to scrutinize your US job, H1B processing, visa processing fee and all will be paid by you company. In case of local US company, you may have to bear those cost..

    The third advantage is, if you complete 5+ years of experience outside USA and then travel to USA then you may be eligible to file your green card under EB2 which will be faster than EB3 category.

    In last 2 years, as soon as the quota opened on Apr 1, USCIS received more number of H1B petitions than the annual CAP limit. I think the possibility of getting selected in lottery system through MNCs is more when compare to local US employers.

    Also, if you bear the cost of H1B filing and visa processing etc. (Obviously it has to be paid by employer, but some emoployers used to charge the employee), then if there is any issue in Visa stamping then it would be waste of money. That's why now a days most of the USA local employers dont file H1 if you are physically not present in USA.

    This are my persoanal thoughts, please consult with legal experts on this.

          All H1B processing costs must be paid by the employer; you will likely have to pay visa stamping costs.

          There is no difference in acceptance from MNCs to local US employers - the USCIS doesn't look at the petitions at all until after the lottery.
