I plan to leave my current employer in 3 weeks, by which time my new employer should already have filed an H1B transfer for me and we should have the receipt notice already. I then plan to take a 12 week break and then start working for the new employer after the break. My new employer has agreed to the start date. My question is, can I stay in the US legally in that 12 week period? I think this sounds reasonable because after receiving the receipt notice, I could be waiting for the approval for say 6 weeks, and once I get the approval, I have 60 days (~8.5 weeks) to join the new employer, according to 20 CFR 655.731. Thank you!
