My friend got fired a few months back while he was on H1. He stayed in US for a couple of months searching for jobs and then left to India to work there, but now he wants to come back to US. Can he use the same H1 as the 3 year period has not yet been finished and come here if he can find a job and transfer his H1 or should he come vistors visa and then transfer his H1 as soon as he finds a job. The question here is whether his previous H1 is valid or not since he over stayed for a couple of months after he got fired. Thanks
