  • Filing GC in the 5th Year

    Hi All,

    My H1B Visa was approved in Nov 2007 ( 7 years Ago) , but since I stayed out of US On and Off, kept visa valid by traveling into US & extending every time, I have 20 months left on my visa to hit the 6 year cap. Currently I am staying out of US, but would be traveling in the next month.

    Could someone kindly help me with the below question

    1. To extend my stay beyond 6 years, GC has to file by a employer before end of 5th year. However my original visa approval is more than 6 years old, will that cause any problems?

    2. My current employer does not do GCs, so once I land in US, I need to switch employer and find a sponsor to file GC, I understand that only about 8 months would be available for switching and filing of GC. Please confirm what steps in the GC process that needs to be completed (stages) before the 5th year ends. And what can be a good estimate. Will I be able to make it??

    3. While I chose the employer for GC Filing, would I be locked into that company till end of GC process ( around 8+ years as i hear) ?
