    Hello All...

    Looking for comments/suggestion very seriously.. a brief about my scenario is as below:

    1. I had my H1B approval in the year 2008 and traveled to US for the first time in Jan 2010.
    2. During in USA, applied for H1B extension in the year 2011 and it got approval.
    3. I traveled to India in Dec 2011 for visa stamping after H1B extension.
    4. During my visa stamping, i got 221g form. i waited 2 months for the reply from USCIS/US consulate (received my H1B revoked letter from USCIS).
    5. Came back to USA on L2 visa (my wife L1B visa dependent) and since then i am working on L2 visa (EAD).
    6. Now i am planning to file a new H1B or refile the old H1B (used only 2 years of old H1B)

    Now, my question is: I am still eligible for H1B cap exempt because i haven't use 6 years of H1B but i have crossed the 6 years limit of first H1B approval i.e. 2008.

    So please guide me am i still eligible for H1B cap exempt ? or not

    Your response would be really helpful now for me to take a major decision.
