I am on H1B through company A. Company B filled H1B in premium processing and got RFE.
1.Can I resign company A and join company B with an RFE?
2.Is it OK to work on company B with an RFE if company A revokes H1B once I resign.
3.After USCIS makes a decision, if the H1 by company B is denied, how many days will I have before I get a receipt number for a new H1B application or H4 application (my spouse is on H1B status) ?
4.While RFE is being worked upon, repsonded and decision is received: If I opt not to resign company A, and work for company B , I will have overlap of about 2 weeks of employment. Is this OK? If not then Can I be on leave with company A and generate a $0 pay during this period, to avoid issues. Is there any other way to avoid issues during this overlap period.
