  • H1b Revoke Notice by USCIS but extension approved

    I am in a difficult situation .. Please help

    My h1b details

    1st H1b Valid for 1 year expired Dec 2013
    1 St extension from Jan 2014 to Feb 2015 ( Got NOIR, on pay issue, difference in pay is very less and emplyer has paid that, we are replying to USCIS)
    2nd extension approved from Feb 2015.

    My question is if USCIS revoke my H1b ,

    Q1 How this will affect my approved H1b?
    Q2 what are my options in case of negative?
    Q3 Can my employer file new H1b in cap exempt?

      I still dont get the clear picture as to why the second extension was approved while first one was still pending. The second extension is based on the assumption that first extension was genuine, so unless your employer solves the first NOIR I dont think your second extension holds merit. Talk to an independent attorney rather than your employer's attorney.
