Hi,
My wife is on H4 Visa with expired I-94 but valid I-539. This means if she travel to India, she has to get H4 Visa Stamping to reenter into US.
She is planning to apply H1B(COS H4 to H1) CAP quota this year, which starts on April 1st. But we need to travel in the month of March and return by April 10th.
Like last year USCIS starts reviewing the applications from April 15th due to lottery. Can we risk the travel in this scenario? If possible, COS will be applicable ?
