  • Applying for H1b (cap-exempt) while 221 g green slip Admin Processing on H4

    Hello All,

    Here is the situation:

F1 OPT-STEM extention. MS in Biotech. Last 6 months were left.
Started working with University in July 2014 to get H1b.
Paper work got delayed. F-1 OPT was expiring on Dec 15th 2014.
Hence took decision to apply for H4 and get it stamped in Mumbai.
Made a few mistakes on DS-160 (clicked Yes on "special skills in biology, chemistry etc")
Got a 221 g green slip on Dec 17th. Provided them with Resume and letter on Dec 18th. No reply as of Jan 23rd.

Employer emailed on Jan 20th that the prevailing wages got approved (which had delayed H1b in first case), and now they can go ahead with my H1b (cap-exempt) with Premium Processing.

    LCA onward steps are pending.

As I can not go back to US on H4 because of 221 g, the only option left is to go with H1b Consular processing.

    Will 221 g affect my H1b petition?
Can I go for H1b stamping if petition is approved?
What precautions do I need to take?

Is there any other alternatives? Will I need to hire any attorney from US?

This is a disaster I have created to myself.
    Please help.

    Thanks
