I would like to share my situation here,let me know your expert opinion on this.
I am working with company A with L1 (blanket) visa ,the first 3 year validity (visa/I94) is expiring in July-2015.
Company B is applying for H1-B in April-2015 with COS in premium process.
Company A wants me to go back to my home country in May-June time-frame (60 days before my visa expiry) for L1B extension stamping from embassy (not willing for USCIS extension path)
I am in dilemma for below scenario (assuming no issues on H1-B visa processing):
- Travelling back to my home country for L1B extension in June-2015 (which Company A wants) after getting my H1-B COS approved by May-2015 (through company B) and reentering US on my extended L1B sometime in June-July-2015
What would happen to my H1-B COS status then ?
Can I start working for company B without going back for H1-B stamping from October-1-2015 , or do I need to go back again for H1-B stamping as the "last action taken" would be L1b stamping at the embassy?
