Hello all,
I’m in a really tough and stressful situation right now. Hope you can help me out regarding my case.
My H1B visa expires in 2017. I recently found a new job with employer B. My last day with Employer A was 1/16 and my start date with Employer B was 1/20 (no gap!). I worked between 1/20 – 1/27 for Employer B and they told me “your H1B visa wasn’t transferred properly; you should be on leave of absence until it’s fixed.” Therefore, they filled a new H1B petition with premium processing on 2/4.
On the other hand, I contacted my former employer and they told me they have asked USCIS to revoke my H1B on 1/22.
Now, I want to know if I’m out of status or not and what is chance of getting my new H1B visa approved on time?
If I’ll have to leave US due to out of status issue, how long it’s going to take until I can come back and work? Are there any possibilities that I get rejected and can’t come back at all?
