I have a situation wherein looking for some expert advise.
- My wife is leaving for India this month by herself and plan is to get her stamping done by next week itself.
- I have TWO approved H1 petitions from company A that are valid from - 2014 to May 2015; and other one from same company A - from May 2015 till May 2018.
- Now while filling up the DS-160, I gave the receipt number of petition that is valid from May 2015 to May 2018 i.e. second one. Also she qualifies for interview waiver and need to only drop the valid documents at visa center for stamping since last stamping was also from Company A for same H4 visa type.
Q1 - Will it be an issue that DS-160 does not mention about petition 1 that is valid from 2014 till May 2015? She will be submitting both the petitions in original anyways along with passport etc.
Also, Company B has filed for my H1 transfer and it is expected to come by this week or next week. However I do not plan to join Company B until wife's Visa stamping is done since I have filled DS-160 with details of Company A (and that is why she qualifies for dropbox program)
Q2 - Will she face any issues with Visa Stamping as it will be based on company A and not company B?
Last Question - When she is returning back to the USA I would have already joined company B. Should she have latest original I797 from company B to clear immigration at US airport? Or original I797 from company A will suffice?
