Dependent Visa out of status. Will be any rejection in future?

Hi,

When I was in L1 from the company "AA" my dependents were on L2. I have converted from L1 to H1 through Company "BB" from October 1st 2014, but my employer "BB" did not file L2 to H4 transfer..

Planning to join "CC" now, when "CC" is trying to do porting of my visa and my dependent Visa, came to know that only my dependents were out of status since October 1st 2014. They suggested to depart my wife out of US and apply for H4 through company "CC" once I joined with "CC"..

Planning to send my wife to home country by March-15. Is there any possibility of Visa denial in India when she goes for stamping..

One more thing I need to mention here is as per I-94 last date is 28-Mar-20115. Addition to this please let me know how long dependents be in US with out of status..
