  • Urgent help regarding question on H1B Masters quota eligibility

    My wife holds a Masters degree from a public US university accredited to the North Central Association of Colleges and Schools, The Higher Learning Commission. She received the original Masters Degree certificate and the Transcripts issued from this US university.

    However, the program she studied was unique in that the entire 2 year Masters program was conducted in Bangalore, India and the faculty from US visited her India campus. Her US university MBA transcripts shows that she completed the credits in Summer 2010, Fall 2010, and Spring 2011 (the 2nd year). The first year's credits were awarded by Bangalore University.

    Questions:

    1. What is the exact criteria for eligibility for H1B Master's quota? What proofs should you furnish?
    2. Would the fact that she studied in India disqualify her from applying under the Masters cap of H1B visa? Technically, she holds “a Masters degree from a public US university which is accredited”.
    3. Also, while applying for H1B using Masters quota, would there be any stage (initial filing or RFE stage) where we would have to provide I-20 or F1 visa or I-94 documents to support her eligibility? She doesn't have these documents.
