    Can i claim itemized deduction on federal taxes under India US income treaty?

    If you were in the US on OPT from Jan to Oct then on H1B from Oct to Dec, you are definitely a US resident, as far as the taxes are concerned. I don't see how you can be considered non-US resident.

    You will have to pay taxes on your income in the US. That has nothing to do with US India tax treaty, which would come into picture only if you had paid taxes in India on Indian income and somehow you were liable to pay the taxes on that same income in the US as well.
