  • Tax Filing when both me and my spouse are Non-Resident Aliens

    I was on OPT and my employer filed for my H1B in 2014 and it was approved.
    I travelled to India in September, got married and both me and my spouse got out our H1B and H4 visa stamps respectively and returned to US in October, 2014.
    I am trying to file my 2014 Tax Return.
    My spouse doesn't have an SSN#, so we are trying to apply for the ITIN#.
    Per IRS regulations, as I do not satisfy the Substantial Presence Test, I am also considered a Non-Resident Alien for the year 2014.

    Since both my spouse and I are Non-Residential Aliens from India, I am wondering how I should file my taxes; Should I file "Married, Filing Jointly" or "Married, Filing Separately"?

    (Few sources on the internet say that we should file separately. But since my spouse doesn't have an SSN#, I am not sure how I must proceed)
