    Hi,

    I had an offer from a desi consultancy client, they under the pretext of H1B Transfer got me sign an offer letter. The H1B petition is approved but I am not confident to join the company.

    Can they sue me for not joining them ?

    Is offer letter/agreement binding even if I have not joined them ?

    The reason I am not joining is because they quoted 70$/hr rate & the offer letter stated 75000$ as my salary, I have been promised that I will be paid according to the LCA ie. 75000$ year & the remainder amount would be a bonus every 3 months which doesn't seem fair.

    Please let me know asap as they are threatening to sue me in court for loss of business and company reputation.

    Does it make sense as I am not a part of their business/company unless they hire me ?

    This is not really an immigration matter but a contract matter.

    It really depends upon what kind of contract you signed with them.

    If you are in breach of contract, they can certainly sue you for the same.
