  • Entering 2 days before H1B visa stamping expiry

I have Visa stamping and expiry from old emp A till June 1st, 2015
I have approved I-797 from current emp B till Oct, 2016

emp A was full time and emp B I am currenly in EVVC model.

Is it possible for me take an india trip and return on May 29th, 2015 without attending stamping. How risky is it to return within 2-4 days of stamping expiry.

Also what if I choose a POE like abu dhabi which might be safer.

    Appreciate your input.

Basically the comparison is between risk in going for stamping with an EVVC model Vs. Risk in entering US 2-4 Days before visa expiry. I would say it is equal risk considering the fact that it is so close to visa expiry.

Abu Dhabhi or any other POE should all be similar as same profile of officers sit at all POEs. Also you would get I-94 only till Visa expiry, and that will give you barely a few days to apply extension as soon as you return. How about advancing the trip or delaying the trip till you actually prepared to attend the visa stamping?

This is my opinion not legal advice.
