I need an urgent help. Let me explain my situation.
I am in F1 OPT. I am employed with A, while B has filed my h1. It has been picked up in the lottery and I got the primary notice. Now I tried to do my STEM extension but my University adviser says they can not provide STEM extension unless this h1 is withdrawn else they can provide me CAP GAP i20.
1. Now if I am in cap gap extension and my h1 gets denied, would I be eligible for STEM Extension after that? What are my options in that case?
2. If I am in cap gap, my h1b from employer B ( petitioner ) gets denied, can employer A file h1 petition?
3. Can employer A (where I am working right now) file a h1 petition? Irrespective of me starting to work for employer B.
