  • H1B extension Query

    I got my H1B stamped in March,2011 for one year. Then I visited the USA and got my extension till April 2014.But due to some reason I left the United States in Jan 2014. So, my I797 and H1B stamping was valid till April 2014.
    Now, I have changed my company. Please let me know if my current company can apply for the H1b transfer and extension under the old H1B cap (i.e. cap exempt) or I need to file new H1B.

    If you have not exhausted 6 Year limit on the H1 petition, then yes another employer can file a cap exempt petition for you as you were in valid H1 status in last 6 Years.
