  • RFE for H1 application with HCL Client letter

    Hi,

    I am working as a contractor with HCL for one of their end client X. I applied for new H1 with a client letter stating 'HCL America' as the client and that I am working in End client X's location. I got an RFE saying that USCIS expects client letter from the end client X. I approached HCL with this, they are not willing to approach the client X for a client letter or even a mail stating the denial of client letter. They are firmly arguing that HCL letter is enough. HCL is willing to give another client letter reiterating that HCL is indeed the end client,not the client X and also I do not have any direct contact with the client X or any of their employees. Even my employer is not able to help with me in this. I would appreciate if anyone can help me on this or even you have had any similar experiences in the past sharing your experience would greatly help.

    If you are being sub contracted by HCL America to another end client, how HCL America can be the end client? Changing the same now would give rise to more suspicion. You have to understand the real reason why USCIS insists on end client letters, they only want to ensure that there is a genuine job and that your employer has the ability to pay. With multiple layers this risk only increases hence the chances of rejection also increase.
