  • Old approved H-1B (2004) - can I get cap exemption now?

    Hi,

    Two questions:

    1. I had applied for H-1B visa through one of my earlier employers. This was applied in 2004. My petition was approved by the U.S. Authorities. However, I didnt get my visa stamped as I decided to leave the company. Given that I didn't go for the stamping, can I use that application and request for cap exemption?

    2. I don't have the details (reference # etc) of my old approved H-1B petition. This is from 2004. Where can I find the same?

    Views appreciated.

    Regards

Its been over 10 Years, you would not be considered cap exempt and need to apply afresh.

This is my opinion not legal advice.
