  • H1 Visa transfer stamping

    Hi,

    I was working for Organization A in US since May 2011. I recently changed my employer in Dec 2014. I have my visa stamped in my passport until Dec 5 this year. My H1 B transferpetition is approved until Nov 2017.

    I am planning to go to India during October and come back in Nov. As I said my visa in passport will be valid until Dec 2015. And I have an approval of my transfer until Nov 2017. Do I need a new stamping to come back?

    What would be questions in POE if I don't need a stamping? Would it differ as I am now working as a contractor to a big organization?

    I would say it is advisable to go for new stamping as it will enable you to get a new visa with dates matching your latest petition. If you dont attend visa interview and dont get a new visa ,you would end up getting an I-94 only till Dec 2014 and would need to apply for an extension after entering US.

    You may also be questioned at POE about your latest employment and associated client letter/SOW etc.
