Here is my spouse's case - currently employed on H1B.
1. Her 6 yrs of H1B will expire by end of Aug 2015.
2. Her PERM was filed end of Jan 2015. (so this rules out 1 yr automatic extension since it wasn't filed before 365 days).
3. So it's likely that her PERM will be approved by July 2015 (by current dates)
4. I have 140 approved and 6+ yrs H1B - so she can go on H4 EAD any time and come back to work. Current estimated approval time is 90 days for EAD.
Here are my questions:
1. Will she be able to work till the end of August even though she files H4 now? Will her status immediately change to H4 the moment she applies?
2. Can we wait for PERM approval and file 140 in premium and then H1-B in premium all before end of august. Looks like the premium processing is paused till July 17th 2015.
Please help me and give me some options so that I can discuss with my attorney. Thanks.
