  • Laid off from current employer after applying for H1b Extension (Change of Employer)

    Hello,

I was employed in Company A and started H1b transfer process to Company B as I was expecting lay offs. Company B submitted my petition for H1B Extension to Change employers on June 10 2015 after getting LCA approved. Petition reached USCIS on June 11 2015. I was laid off on June 12 2015. I did not get H1b receipt notice yet. Given this scenario, I have a few questions:

    1. Is there any chance of not getting receipt notice?
    2. What can i do if I don't get receipt notice?
    3. When can I start working for new employer?
    4. How will the lay off affect my status?

    1. Is there any chance of not getting receipt notice?
    >>> If your documents reached USCIS, then you will always get the receipt notice. It takes about 2 weeks.

    2. What can i do if I don't get receipt notice?
    >>> You will get it. Give it 2 weeks.

    3. When can I start working for new employer?
    >>> You are allowed to start working for the new employer as soon as your receive the H1B receipt notice.

    4. How will the lay off affect my status?
    >>> There will be no impact since your transfer was filed before you got laid off.
Not a legal advice. Use of this information is strictly at your own risk.
