  • conversion from L1-B visa to H1-B visa

I have filed H1-B application in April'2015 thru company A when I was outside USA while working for company-B, It was picked-up in lottery.

In May'2015 I entered into USA on L1-B visa thru my company-B.

My company-B also applied H1-B this April'2015 when I was outside USA, even that also picked-up.

Now, my question is How the status change from L1-B to H1-B process works ?
What is the best option Company A or B to consider for this status change ?

please suggest in this and help me to come out from this confusion.

    Thanks !!

As both of your H1 were applied while you were outside US both petition would be approved as consular option. Using the approved petition either company A or B can file a Change of Status to change your status from L1 to H1.

This is my opinion not legal advice.

Alternatively, you can leave the country, get the H1B visa stamped based on Company A or B's petition and return back in H1B visa. That will put you on H1B status. If you show Company A approval notice at the POE, then you should be working for Company A. If you show Company B's approval notice at the POE, you should be working for Company B.
Not a legal advice. Use of this information is strictly at your own risk.
