  • US 6 year stay counter reset

    I had stayed in US for 3.5 years on L1-B visa (Sept 2010 to April 2014) and before travelling to india in April 2014, my employer had filed fresh H1-B petition for me which got approved and my new H1-B was stamped in Dec 2014. Then I came back to US again in May 2015 (i.e after staying in india for 1 year 1 month). I wanted to if my 6 year US stay counter is reset since I was out of US for more than 1 year.

    Your visa stamping or the date you re-entered U.S has nothing to do with the H1B clock reset. The time between your last exist from U.S and your H1B (filed under a new CAP) effective date should be 1 year for the clock to reset (for the clock to reset, you shouldn't have entered U.S in any other non-immigrant status during that period).

      Thanks for your reply.My exit date from US is April 20th 2014 and H1-B cap petition effective date was Oct 1st 2014. So does that mean my H1-B counter was not reset?
