  • Taking a break on H1B

    Hi
    I am currently working on H1B in US.
    I will quit my current job and move back to India.

    My next job might be after some months in India.

    1. Does my H1 expire?
    2. If next employer wants to get it transferred, can they?
    3. My H1 validity is till Jan 2018

    Thanks

    1. Does my H1 expire?
    >>> H1B petition will be valid until its expiry date or until the employer revokes it (whichever happens first). Even then, you can find a new employer to file a new CAP exempt H1B petition using the CAP from the existing petition.

    2. If next employer wants to get it transferred, can they?
    >>> Yes.

    3. My H1 validity is till Jan 2018
    >>> Doesn't matter if you are no longer working for the employer who filed that petition.

      [ITBA] So new employer will need to file again, just that it won't go through the lottery process?
