  • H1B processing using I129 of 2001

    I need your valuable suggestion.

I have applied H1B in September-2001 but unfortunately got rejected and received 221(G) and never got a chance to go for H1B processing again.
But my question is can i use the same I129 now and go for H1B reprocessing. I did check the receipt number in USCIS and I129 is still approved.

    Thanks in advance.

I-129 status will show approved. But is your approval notice still valid? Form I-797 should be valid to attend the visa interview. The max duration for which I-797 is approved is for 3 years. Also, does the job for which that form I-129 is filed is still valid? The job need to exist for you to attend the visa interview.

So the very simple answer is NO.
Not a legal advice. Use of this information is strictly at your own risk.
