  • How to face H1B VISA interview ??

    Hello,

    My existing H1B VISA application is under 221G process for client documents. Since my employer does not able to get the client letter, they are amending my petition to other client. This time we submit all the client documents (MSA, SOW, PO, client letter specific to me) along with petition. We have sent withdrawal request for the existing petition as well.

    After amendment petition approval, i would attend the interview again.

    Now i would like to know, what questions i may expect from VO ?

    would there be any issue with the first application withdrawal ?

    Is there a chance to get another 221G ?

    Please advice.

    That's okay. Just answer everything truthfully and confidently.

    221g will have to be mentioned as denial in your subsequent application.

      OP mentions that his employer is withdrawing the petition since its stuck in 221g with no chance of approval now.

      So, doesnt that mean his visa is rejected and he is no more eligible to file any petition amendment this year as the original petition itself is withdrawn.

      If he has to then his employer will file a Cap-Subject petition during Apr-2016. I am little confused with this case. Because this will mean anyone who gets rejected in Visa interview can simply file an amendment and re-appear for interview.

      PS- All above based on assumption that OP is talking about H1B 2015-16. If he is talking about previous year's petition then pardon me please.

        Sorry, i made a mistake in my above post. We are withdrawing the VISA application which is under 221G and not the existing petition.

          221g is considered as Visa denial and must be mentioned in DS160, unless it is subsequently cleared and Visa is issued. Withdrawal of Visa application does not matter.
