  • H1B Stamping questions

    Hi

    I am going to H1b/H4 stamping next week along with my wife & Kid. I am working in client location for the past 1.5 years and I am in India now for vacation. Hence need to go for stamping. I have following clarifications and appreciate anyone's expertise. I am working in a good reputed company with close to 10,000 employee strength globally.

    1) Offer Letter - The offer letter which I carry (hard copy) do not have the signature of my HR manager and I missed to note this initially. I just noted when my employer asked to carry the original copy of the offer letter. I tried to get the signature of HR manager but he left the company. Hence I reached my employer and they have sent me the soft copy of the offer letter that contains same HR manager signature (on behalf of employer). Luckily the copy which was maintained by my employer is good with all signatures. Now my question is, if the VO ask the offer or contact letter, should I have to show the original hard copy of offer letter without HR manager signature or should I have to show the copy of letter with HR manager signature? Is there any risk associated with any of these two?

    2) Employment Verification Letter - I have read through many post that employee verification letter is one of the supporting document to be carried out. But my employer says this is not required for H1B stamping. I am working in Client location for the client through my petitioner. I hope this one does not come under EVC model? Please help to clarify if employment verification letter is required or not?

    3) PERM - My employer is processing GC and currently it is been submitted for labor in DOL. If the VO ask any thing about how many years you are planning to stay in United states, I am sure I need to answer only until Petition end date and will be saying I will return back before that. But is there is a chance VO will know my employer is processing GC and it is with labor? If so, will he not think I am providing false answer with the fact I am trying to be a permanent resident?

    4) Previous employer experience letter - I was not able to collect the hard copy of experience letter from my previous employer in US and I have only soft copy of the letter. Will there be any issues if I show the soft copy of the letter to VO if its asked?

    5) Leave letter - As I have come here to India for my vacation, is there any leave of absence letter from my employer with number of days specified in the letter to be carried?

    >>> The copy with the manager's signature will do. Get a recent employment verification letter in the company's letter head and that will help.

    >>> Employment verification letter will help. If you have been working for the same employer for a long time, then your offer letter will be old. To prove that your employment with the petitioner still exist, an employment verification letter will help. Especially when you are carrying only a copy of the offer letter, employment verification letter will help. In most cases, the VO won't even ask for these letter. But it is always good to carry them.

    >>> They won't ask anything like that. You need to mention that you will stay until your petition expiry date.

    >>> No issues.

    >>> Nope.
