Expired H1B

Hi,

I am in India got my H1B visa stamped this week. My husband has the expired H1B visa, stamped in 1998 and expired in 2001 but he never traveled to US using that visa.
Now we would like to travel. Is he eligible for Cap exempt? shall we approach any of the employer to transfer and extend this visa?

One H1B CAP is valid only for 6 years. He need to wait till next April to file under a new CAP.
