Hi All

I am having old H1-B approved petition . It was approved on Aug 2009 and my validity came as oct 2009 to sep 2012.

I was in India and not used old H1B petition .

I was attend stamping in 2010 but got querry to project related and submitted the docs in VFS but no response.

I guess my petition will come into Cap exception .

Could you please tell me how long my petition will valid i.e till Aug 2015 or Sep 2015 ?

Please help me out on this.

I am still getting confuse on this total valid 6 years.

My H1-B petition "noitce date"(i guess this is petition approved date) is 10th Aug 2009 and initial validity period came as 01st oct 2009 to 25 setp 2012.

Now my question is 6 years period calulcationg from 10th Aug 2009 or 01st oct 2009?

It starts from the effective date of the petition (Oct 1st). But only the time that you have spent in U.S in H1B (+ L1) status counts. Time spent outside U.S does not count. If you have never been to U.S, then you have all 6 years to utilize.

I was in US during Feb 2008 to Dec 2008 on L1 -B .

My H1-B approved on 10th Aug 2009 .

I haven't used H1-B petition till now , In this case my case will come into cap exception ?
