  • H1-b visa extension for passport expiring within 6 months

    Hello all,

My wife's passport is expiring in Jan 2016 and her H1-b visa on Sep 23rd 2015.

Her employer has to file the extension and since the passport is expiring within 6 months from now(Aug 2015), there was a confusion whether to renew the passport or to go for the h1-b extension without renewal.

Finally, the immigration team in my her company has decided to apply for the h1-b visa extension(in premium processing i believe) without renewal.

What are the risks/chances of rejection involved in this case?

    Thanks

There won't be a rejection because of this. At the most, what can happen is that the H1B extension is granted only till the passport expiry date and you will need to file another extension upon renewing the passport. There are also chances that they completely overlook the passport expiry date and issue the H1B extension for a longer period.
Not a legal advice. Use of this information is strictly at your own risk.
