  • Do I qualify for Interview Waiver Program? Kindly help

Thank you reading this post and appreciate your response.

I need to know whether I qualify for the interview waiver program. Please help. Its urgent because "Need to return back to USA in 2 1/2 weeks. In Chennai consulate the 1st available appointment is in Nov 2nd 2015... which is 3 months from now".

    Here is my situation:

    1. Was working for company A starting Jun2011 on h1b
    2. Travelled to India in 2011 and got h1b stamping valid for 3yrs until May2014

    3. Moved to company B after an year and got I797 valid until Nov2015
    4. Travelled to India in 2013... Didnt go for stamping... Used the existing stamp though it is from different employer.

    5. Now my visa stamp expired in May2014 (15 months now since expiration)

    6. My h1b renewal is approved
    7. I need to travel to India for an emergency and need to return back to USA in 3 weeks. In chennai consulate the 1st available appointment is in Nov 2nd 2015... which is 3 months from now.

    8. Do I qualify for the interview waiver program ?

I read the documentation by confused. Please help. No where mentioned about the employer.....

    1. You received your previous visa after November 1, 2008.
    2. You currently hold/previously held H1B visa which you are renewing now.
    3. Your H1B visa is still valid or recently expired (expired within the last 12 months).
    4. Your previous visa was issued in India.
    5. You do not have any refusals for a visa in any category after your most recent visa issuance.
    6. Your prior visa is not annotated “Clearance Received”.
    7. Your most recent visa (in the same visa class for which you am applying) was not lost or stolen.

Thank you shervin143. Can I get emergency appointment for work reasons? If yes what kind documents would be needed?
