    Hi,

    I entered in US with my family on H1B/H4 in October 2014. I-94s for me and dependents are valid till 15 October 2015. My current employer has already filed extension for me and my dependents in July and I got receipt number for I-129 and I-539. as they have filed extension in normal processing it will take time for approval. I am planning to join new Employer in august last week and new employer has already filed my premium H1b visa. Due to some miscommunication new employer has not filed I-539 for my dependent, now they are saying once you join we will file i-539 for my dependent.

    My question is : can my wife stay on the basis of I-539 File Number filed by my current employer if my new employer could not file I-539 before 15 October?
    Any other suggestion.

    Yes. They can stay since the extension was already filed. Make sure the previous I-539 doesn't get withdrawn, which will be a problem.
