H1B denied, visa until 2016

  • H1B denied, visa until 2016

    Came to the US to study, afterwards I started work after getting a work permit. After my second work permit, my work applied for my H1B. It came back two days ago saying denied. My visitor's visa says it expires in 2016, but I'm told that after a H1B denial I should leave the country immediately. HELP.

    What is your current immigration status? You said that you came to U.S to study. So are you currently in F1 OPT?

      No, OPT ended while the H1B was getting processed.

        Well, in that case you do not have any other option. You should leave the country immediately to avoid accumulating illegal stay (I am assuming your I-94 already expired).
