Hi,
I am on a valid H4 visa. I have got my H1b petition approved this year and is applicable and valid from October-1st-2015, but I have to travel to India on October-10th-2015 and will be back on October-31st-2015. My husband also needs to get his H1 visa extension stamped in October during our travel to India.
I have certain questions regarding the visa stamping and status:
1. If I get my stamping for H4 visa based on my husband's H1B, will my H1B petition be cancelled or maintained?
a. If yes I can maintain the petition, can I change the employer immediately after coming to USA on H4, using my existing H1B petition?
b. If yes, I can change the employer, what does the new employer need to do?
2. Is there any alternate other than COS to transfer H4 to H1?
