    Hello, My passport is expiring in 10 Months (July 2016). I am travelling to India from USA in November 2015 planning to get my visa stamped and return to USA in December end.

    My question is since my passport will expire in 10 months, when i appear for visa interview in December, how long my new visa will be issues? Will it be issues till the expiry date of my passport or expiry date of my Petition (I-129)

    I spoke to CGI India and they told it is up to the consulate officer. Please share your experience.

    It is up to the consulate officer. If your passport validity is less than 12 months, then the officer can issue you the visa only till the passport expiry date. The same applies when you enter U.S. The officer can issue you the I-94 only till the passport expiry date even if the visa is issued till the petition expiry date.
