  • Have a new H1b.

    Hi friends.

I have recently got an H1b, but, my employer is going to take time to send me US. It may take longer. I wanted to know if there is a possible to transfer the H1b without going to US if I get a project and ask them to transfer my visa to their company and then I can travel.

Is it possible? If risky.. what are the risks involved?

There is nothing called a "transfer of a visa". But what the next employer can do is file a cap exempt h1 petition for you. You would have to provide them your current h1 approval notice. When this petition is approved, the employer would receive a new I797. Using the same , you can travel to US, though the visa will still have current employer name, but the petition would have new employer's name.

This is my opinion not legal advice.
