  • Amendment process from india

    Hello All,

    I am working for X company in india and they filled my h1b and stamping also done recently. All of suddenly we have lost the position at onsite and need to work for another client.

    because of change in client,location and my role, my company filed premium amendment. currently i am in India and not traveled to USA yet. I have few questions so please help me.

    my petition validity is only for 1 year and stamping is also done for only year.

    1)Do i need to go for stamping again?
    2)are there any rejections?
    3)will i get new petition with different validity?
    4)what will happen to existing visa if they reject at the time of stamping?

    Thanks,
    Reddy

    1)Do i need to go for stamping again?
    >>> Not required. You can use the current visa to travel as long as it remains valid.

    2)are there any rejections?
    >>> Not sure what you are asking. Of course there are rejections. Not all petitions gets approved.

    3)will i get new petition with different validity?
    >>> Yes.

    4)what will happen to existing visa if they reject at the time of stamping?
    >>> If the amendment gets approved, you can use that to travel along with the existing visa. If you go for visa stamping, then they will cancel the existing visa before determining whether to issue the new one or not.
