2015 H1 is on RFE and Applying 2016 H1

  • 2015 H1 is on RFE and Applying 2016 H1

    I am in India and I have applied for H1 through employer#1 under 2015 quota, It has got RFE so we just responded to RFE and waiting for response. My employer#2 (for which I am working) is planning to apply for H1 under 2016 quota. I have few questions as below please clarify -

    1. What if my emp#1 H1 gets approved and emp#2 H1 is applied under 2016 quota, will there be any problems for my new petition ?
    2. What if my emp#1 H1 gets rejected and emp#2 H1 is applied under 2016 quota, will it impact on the new H1 processing ?
    3. What if my emp#1 H1 gets approved and I go for visa stamping at consulate (in the meanwhile emp#2 applied for new H1), will there be any impact.

    History of my visa applications - I had worked in US for 3.5 years under L1B visa and came back to India then processed H4 under my wife primary H1 visa and visited US for 2 months and came back. Recently my emp#2 applied for L1 Indivisual and though it was approved at USCIS but it was rejected at consulate when I went for visa stamping.

    Need help.

    If there is not a one year gap between your last US visit and current H1 processing, then you would get only 6 Years minus time already spent in L1 status.
