Entering USA with limited days valid on H1B visa

I wanted to know if it is ok to return back to USA with 40 days left on H1B Visa expiry. My company is ready to do premium processing for extension after i come back. Please suggest if i should file for extension and travel for vacation or should I come back with existing valid visa and then file after recieving new I94.

It should be fine. Do not file extension and then leave while it is pending. Either file extension in premium, get approval before leaving, or file extension after returning.
