    Hi all,

    I have a question about the interview waiver program. My last visa was stamped in May 2014 in Chennai, when I went for vacation. In Nov 2014 I moved to a new employer.I am planning for a trip to India in Nov 2015.

    My previous employer revoked my H1B in May 2015. Am I eligible for Visa waiver program?

      Visa expiry date is 12 Apr 2017.

        Are you mentioning about the visa that is stamped in your passport or the H1B petition expiry date. If your current visa is stamped until 12 April 2017, then why do you need a new one under the same category? Check the below link to figure out if you are eligible for visa interview waiver.

          My passport has visa stamped until 2017. But thats for my old employer. He revoked my old H1b in May 2015.That's where I have a question? I am with my new employer now. Interview waiver program look for same petitioner or no?

            You do not need a visa in that case. You can use the old visa to travel by carrying the new approval notice. But if you want to get the visa stamped, then you certainly do that. If all the criteria in the link that I provided you meets in your case, then you are eligible for the visa interview waiver.

              I understand. In the Eligibility questions for IWP, it doesn't mention anything about an old revoked Visa. My passport has visa stamped until 2017. But the H1b petition back in US has been revoked by the old employer. In that case, I am not sure what would be the answer for :

              If I am applying for an H or L (individual) visa, my prior visa in the same class is still valid or expired within the last 12 months.

              If any one has faced a similar situation, Please let me know.

                This question has nothing to do with the H1B petition. It clearly asks about your visa in the passport. Since your previous H1B visa is still valid, you should answer YES.
