Query in H4 Extension

    Hi,
    I was working with employer A and myself and my dependents got our visa with employer A which is valid till sep-2016. Now i moved to employer B when i moved to employer B my wife and kid were in INDIA and they traveled with employer A H4 visa. Now we are all with my old employer visa and i have my new I797. None of us are having new visa with my current employer.

    Now my question is. if i go to india before my current stamped visa expires do i need to do H4 extension for my wife and kid or we can go for stamping with my new i797 ?
    Please clarify on this.

    No need to go for stamping since your visas are all valid until Sept 2016. You can use the existing visas to travel back. But you need to show the latest H1B approval notice of your current employer at the POE. There is no need to file the H4 extensions now since your dependent's I-94 are valid until Sept 2016. While returning back, they will get an I-94 matching your current H1B petition expiry date.
