  • Amendment Petition

    Hi

I have a vaild petition when i changed my Employer, this petition is valid till September 2017, however my VISA on my passport from my Original employer expired September 30, 2015. For this reason i was planning to go for stamping this December.

Mean while as my Client work location changed (which is less than 20 miles), they filed a Amendment Petition in July 5th 2015 under regular processing mode, this is still pending.

Do i need this petition for attending Stamping in INDIA, or my original petition would be enough ( as the new work location doesn't potentially need a new LCA to be classified for Amendment), As Amendment has been filed anyways would this impact my stamping process if i attend interview without this Amendment approval.

What can i do best at this stage, so far it has been 4 months still i didn't get my Amendment approval. I am planning to move this to Premium processing mode, will this help me get the approval by my Travel date which is on November 24th 2015. Please suggest what best can i do without missing my travel date.

    Thanks,
    Abhishek

It is advisable to get the amendment approved before you attend the visa stamping to avoid unnecessary delays. You can upgrade your case to premium and get the result within 15 days or wait until a decision is made on your case under normal process and then go for visa stamping. It is taking about 4-5 months to get a decision under normal process.
