L2 to H4 and L2 to H1

Hi,

For an individual who is on a L2 visa.....is it possible to file for L2 to H4 status change and also L2 to H1 status change at the same time?

Your quick response in this regard will be greatly appreciated.

Hi,
You can have only one non-immigrant status at any given point of time. If your petition to change status from L2 to H4 is approved, then you will be on H4 status. It does not actually make sense if you file 2 COS petitions and expect both to be processed and approved. So decide between the H4 and H1b

Actually, around Jul '05 I had applied for the following...

L2 to H4 and also L2 to H1

I did so because even if H1 do not go through for some reason....I will be able to continue to stay in the US based on my H4 approval.

Now....my L2 to H4 got approved in Aug '05 itself.
But my L2 to H1 is still in processing state in Vermont Center.

a) Do you think whether there will be any issues with my L2 to H1 petition because of my L2 to H4 approval?

b) If L2 to H1 also gets approved....which one will be my legal status...H4 or H1?
