Travel to india while LCA/Amendment in progress
Hi all, Need urgent and genuine help
I was working in Chicago till 30th Sept and now getting relocated to a new location in Texas. LCA is in progress and amendment will be filed in 1-2 weeks.
My H1B visa is valid till sept 2016
LCA was posted on Oct/28.(assuming it will take 10 working days from that day onwards for it)
Amendment will be filed around 15th Nov I guess.
Right now i need to travel to India urgently for some family matter, but employer is not in favor of that.not sure why ?
Can anyone answer my below queries ?
1. Can i travel to india for a week while LCA/amendment in progress, assume leave by Nov/7 and return by nov/15. will I be allowed to enter at PoE ? (i will be having valid visa but no amendment receipt number) If yes do i require any additional document ?
2. Assume if above case is false and I can not fly until amendment is filed then ,
Can i travel once amendment is filed ?
OR
Is it a must to have the receipt number before leaving from US to india or it is required only when I am coming back from India ?
If anyone have such experience or knowledge please let me know on urgent basis
